When employees resign or are dismissed, one question comes up time and again: What happens to unused holiday? Remaining leave on termination is protected by law and does not automatically expire. The key factors are the leaving date, the accrued holiday entitlement, and what has been agreed with the employer. By planning ahead, you can either take your outstanding days or receive payment in lieu — and avoid losing out financially.

When employment ends, statutory holiday entitlement continues to apply. Under UK law, employers must either allow the employee to take outstanding leave during the notice period or pay it out as holiday pay in lieu. Only if it is genuinely impossible to take the leave before the termination date does a financial payment become due.

How remaining leave is handled in practice depends on the type of termination and the length of the notice period.

  • If the employee resigns: You can request to take your remaining holiday within the notice period. The employer may only refuse if there are pressing business reasons.
  • If the employer terminates: The employer can require the employee to take outstanding leave during the notice period, or they can include it as part of garden leave arrangements.
  • Garden leave: If the employee is placed on garden leave with holiday set off against it, the leave is considered taken — provided this is explicitly stated in writing.

How is holiday entitlement calculated on termination?

If you want to calculate your holiday entitlement on termination yourself, you need to consider the date of leaving and the proportion of the leave year that has been worked. In the UK, the statutory minimum is 5.6 weeks per year, and entitlement accrues proportionally — typically at 1/12 of the annual allowance for each complete month of service in the current leave year.

Calculating holiday entitlement when leaving before the leave year is complete

If the employment ends partway through the leave year, only a pro-rata entitlement arises. For each complete month of service, you are entitled to one twelfth of your annual holiday allowance.

Example

Example: With 28 days of annual leave and a termination date of 31 March, the calculation is: 3 months × 2.33 days = 7 days of accrued holiday.

Calculating holiday entitlement when leaving in the second half of the leave year

If the employment ends in the second half of the leave year and the employee has been in post for more than six months, a larger proportion of the annual leave will have accrued. In many companies, contractual terms grant the full annual allowance once the employee has completed six months of service in the leave year.

Special case: Holiday entitlement on termination during probation

If employment ends during the probationary period, holiday entitlement still accrues on a pro-rata basis from day one. UK law does not allow employers to withhold statutory leave during probation. Any accrued but untaken leave must be paid out on termination.

Is remaining leave paid out on termination?

If the employee cannot take their holiday before leaving, an entitlement to holiday pay in lieu arises. This means the remaining leave is paid out financially rather than taken as time off. The right to payment arises automatically once employment ends and there are still outstanding holiday days.

The payment should be included in the final payslip, unless a different arrangement has been agreed. Employers should not delay the payment or offset it against disputed claims.

When does the entitlement to remaining leave on termination expire?

The critical point is whether the leave was taken or paid out in time. Under UK employment law, statutory holiday must generally be taken within the relevant leave year. If employment ends before that, the entitlement persists until the termination date.

Expiry of remaining leave on employee resignation

Special case: Remaining leave during sickness

If an employee falls ill during the notice period, the holiday entitlement is preserved. The notice period does not automatically extend. Only if the leave cannot be taken because of illness will it be paid out. This principle was reinforced by the European Court of Justice and applies across the UK.
